These Terms and Conditions govern the use of SportAndFashion.eu and purchases made through the online store.
By accessing this website or placing an order, you agree to these Terms and Conditions. Nothing in these Terms limits any mandatory consumer rights granted to you under applicable European Union or national consumer protection law.

MBD Distribution s.r.o. is the seller and contracting party for purchases made through SportAndFashion.eu.
2. Scope
These Terms and Conditions apply to orders placed through SportAndFashion.eu by consumers.
A consumer is a natural person acting for purposes outside their trade, business, craft or profession.
Additional mandatory consumer protection rights may apply according to the country in which the customer normally resides. These Terms do not exclude or restrict such mandatory rights.
3. Products
We make reasonable efforts to ensure that product descriptions, photographs, sizes, colours, specifications and other information displayed on the website are accurate.
Colours and appearance may vary slightly depending on the customer's device, screen settings and photography.
Product availability is subject to stock. Adding a product to the shopping cart does not reserve it.
If, after an order is placed, a product is found to be unavailable, we will inform the customer as soon as reasonably possible and refund any amount already paid for the unavailable product.
4. Prices and VAT
Prices displayed on SportAndFashion.eu are shown in the currency applicable to the customer's market.
Prices displayed to consumers include applicable VAT where required by law, unless clearly stated otherwise.
The applicable VAT rate may depend on the country of delivery and applicable EU VAT rules.
Any delivery charges or other applicable charges will be clearly displayed before the customer submits the order.
We reserve the right to change prices at any time. Price changes do not affect orders that have already been accepted.
In the event of an obvious pricing or technical error, we reserve the right to cancel the affected order. If payment has already been made, the amount paid will be refunded.
5. Placing an Order and Conclusion of Contract
Products may be selected and added to the shopping cart.
Before submitting an order, the customer has the opportunity to review the products, quantities, delivery details and total price and to correct errors.
By clicking the final order/payment button at checkout, the customer submits a binding offer to purchase the selected products.
After the order is submitted, the customer will receive an electronic order confirmation.
The sales contract is concluded when we accept the order. We reserve the right to refuse or cancel an order where there is a legitimate reason, including product unavailability, an obvious pricing error, suspected fraud, inability to process payment, or incorrect customer information.
If we cancel an order after payment has been collected, the corresponding amount will be refunded.
6. Payment
Available payment methods are displayed during checkout.
Payments may be processed by third-party payment service providers. Customers may therefore also be subject to the terms and security procedures of the relevant payment provider.
The customer is responsible for providing accurate and valid payment information.
We do not receive or store complete payment-card details where these are processed directly by an authorised payment service provider.
7. Delivery
Available delivery methods, delivery charges and estimated delivery times are displayed during checkout where applicable.
Customers are responsible for providing a complete and accurate delivery address.
Orders may be fulfilled from warehouses or fulfilment locations within the European Union.
Delivery times are estimates unless expressly agreed otherwise. Delays may occasionally occur due to circumstances outside our reasonable control, including carrier delays, weather, customs procedures, public holidays or other disruptions.
Risk of loss or damage to goods passes to a consumer when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods, subject to applicable law.

8. Right of Withdrawal
Consumers purchasing online generally have the right to withdraw from the purchase contract within 14 days without giving any reason, subject to the exceptions provided by applicable law.
For purchases of goods, the withdrawal period generally expires 14 days after the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
To exercise the right of withdrawal, the customer must clearly inform us of the decision to withdraw within the applicable withdrawal period.

The customer may use the model withdrawal form provided in our Return and Refund Policy, but use of that form is not mandatory where the law permits another clear statement of withdrawal.
9. Returns
Unless otherwise agreed or required by applicable law, products returned following withdrawal must be sent without undue delay and no later than 14 days after the customer has communicated the decision to withdraw.

Customers should preferably contact support@sportandfashion.eu before sending a return so that the return can be correctly identified and processed.
Unless we have agreed to bear the return cost, the customer bears the direct cost of returning products following a change-of-mind withdrawal, subject to applicable consumer law.
This does not affect the customer's rights concerning defective, incorrect or non-conforming products.
Products should be returned with all accessories and components supplied with them.
A consumer may inspect and handle a product to the extent reasonably necessary to establish its nature, characteristics and functioning. The consumer may be responsible for any diminished value resulting from handling beyond what is necessary for that purpose, where permitted by applicable law.
10. Refunds Following Withdrawal
Where the customer validly withdraws from the contract, we will reimburse payments received from the customer in accordance with applicable consumer law.
Where required by law, this includes the cost of the least expensive standard delivery method offered by us.
We are not required to reimburse additional delivery costs resulting from the customer's choice of a more expensive delivery method than our standard delivery option.
Refunds will generally be made using the same payment method used for the original transaction unless otherwise agreed.
We may withhold reimbursement until we have received the returned goods or the customer provides evidence that the goods have been sent back, whichever occurs first, where permitted by law.
11. Exceptions to the Right of Withdrawal
The statutory right of withdrawal may not apply to certain products where an exception under applicable law applies.
Examples may include:
- goods made to the customer's specifications or clearly personalised;
- sealed goods that are not suitable for return for health-protection or hygiene reasons where the seal has been removed after delivery;
- other goods for which applicable consumer law expressly excludes the right of withdrawal.
Where an exception applies to a particular product, relevant information will be provided where required.
12. Defective or Non-Conforming Products
Consumers benefit from the statutory legal guarantee of conformity provided by applicable consumer law.
Under EU consumer rules, goods are generally covered by a minimum two-year legal guarantee of conformity.

Depending on the circumstances and applicable law, the consumer may be entitled to repair, replacement, a price reduction or termination of the contract and refund.
Statutory rights relating to defective or non-conforming goods are separate from the 14-day right of withdrawal and are not limited by our voluntary return procedures.

Nothing in these Terms prevents consumers from using an applicable alternative dispute resolution body or exercising their rights before the competent authorities or courts.
The former European Commission Online Dispute Resolution (ODR) platform is no longer available, having been discontinued on 20 July 2025.
14. Promotions and Discount Codes
Promotions, discount codes and special offers may be subject to additional conditions communicated with the relevant promotion.
Unless otherwise stated:
- promotional codes cannot be exchanged for cash;
- only one promotional code may be used per order;
- promotions are valid for the stated period and while applicable stock lasts;
- certain products or brands may be excluded.
We reserve the right to cancel or refuse a promotion where it has been used fraudulently, unlawfully or contrary to its stated conditions.
15. Intellectual Property
The content of SportAndFashion.eu, including website design, text, graphics, logos and other original content, is protected by applicable intellectual property laws.
Third-party product names, trademarks, logos and brand names remain the property of their respective owners.
Nothing on this website grants the user any licence or right to use intellectual property except as necessary for ordinary personal use of the website.

Customers must not use the website in a way that:
- violates applicable law;
- infringes the rights of another person;
- interferes with the operation or security of the website;
- attempts to gain unauthorised access to systems or data;
- uses automated systems to abuse or disrupt the website.
We may restrict access where reasonably necessary to protect the website, customers or our legitimate interests.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including mandatory consumer protection rights.
To the extent permitted by law, we are not responsible for losses caused by circumstances outside our reasonable control.
For consumers, nothing in this section affects statutory remedies relating to defective goods, non-performance or other mandatory consumer rights.
20. Applicable Law and Consumer Protection
These Terms and contracts concluded through SportAndFashion.eu are governed by the laws of the Czech Republic, subject to mandatory consumer protection provisions that may apply in the consumer's country of habitual residence.
A choice of Czech law does not deprive an EU consumer of mandatory protections afforded by the law that would otherwise apply to that consumer. Cross-border consumer contracts can therefore remain subject to mandatory protections in the consumer's home country.
Any dispute may be submitted to the courts having jurisdiction under applicable law. Nothing in these Terms limits a consumer's statutory right to bring proceedings before a court having jurisdiction under applicable EU or national law.
21. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes to our business, website, services or applicable law.
The version applicable to an order is generally the version in effect when the order is placed.
The latest version will be published on SportAndFashion.eu together with its update date.
